Additional Detail:

Our client was injured when another driver failed to yield the right-of-way at the intersection of Highway 50 and Highway 370 in Sarpy County, Nebraska. Our client came to us over three years after the crash, just months before the running of the statute of limitations. Liability was not disputed; however, the insurance company for the at-fault driver disputed causation of our client’s injuries. The initial offer from the at-fault driver’s liability insurance company was $20,000.00, which was less than our client’s past medical expenses.

The main difficulty in the case was that our client was an extremely active person and outdoor enthusiast who was involved in two subsequent biking accidents following the crash, both of which resulted in significant injuries and surgical intervention. The insurance company attempted to blame our client’s chronic neck pain and the resulting medical treatment on her two subsequent bike accidents.

Fortunately, through strong preparation and coordination with our client’s medical treatment providers, we were able to tell our client’s story, making it clear that her neck pain and resulting radiofrequency ablation (RFA) treatments were a direct result of the car crash. After nearly two years of litigation and less than a week before trial, the defendant insurance carrier increased its offer to $100,000.00. Our client declined to accept, the case proceeded to trial, and the jury returned a verdict in favor of our client in the amount of $232,700.00.
