Owner Liability
Owners of dogs in Nebraska are strictly liable for injuries caused by their pet. Nebraska Revised Statute Section 54-601 states “the owner or owners of any dog or dogs shall be liable for any and all damages that may accrue to any person, other than a trespasser, by reason of having been bitten by any such dog or dogs.”
Even with strict liability laws, people are often hesitant about consulting with a dog bite injury lawyer regarding their injury claim. Dog bite cases can be extremely sensitive situations, as the owner of the animal is often a neighbor or close friend, and people typically think of their dog as another member of the family. Many times injured victims are reluctant to pursue compensation for their damages because of these close relationships.
Understanding a Dog Bite Claim
If you or your child have been injured from a dog bite, the injury attorneys at Chandler Conway can help you understand what pursuing your claim may or may not accomplish. Most dog bite injury claims are covered by insurance and initiating a claim against the dog owner should not be considered a personal attack. It is also important to get as much information as possible regarding the animal that bit you. In addition to gathering records that may be relevant to your case, you will want to know health information about the dog such as whether or not it has been, or needs to be, tested for rabies.
If you have been injured by a dog bite, in addition to other things, you may be entitled to compensation for:
- Past medical bills
- Future medical bills
- Physical pain
- Mental suffering
- Inconvenience
- Lost wages
As with other injury claims, valuing your dog bite claim is very case specific. Everyone is different and everyone’s case is different.
